Privacy Policy

Gatelyst is a product and service operated by Emergent Marketing Inc.. Gatelyst is not a separate legal entity. In this policy, “we”, “us” and “our” mean Emergent Marketing Inc. when acting as operator of the Gatelyst platform.

This policy applies to the Gatelyst platform and services operated by Emergent Marketing Inc.. Businesses that use the platform are independent tenants; information belonging to a tenant’s own customers is held scoped to that tenant, and Emergent Marketing Inc. operates the underlying infrastructure. The roles each party takes are described in Operators and our role, and the entity relationship is set out on the Legal Entity & Brand Relationship page.

This policy applies to the Gatelyst website at gatelyst.com and to the Gatelyst platform, including purchase, registration, queue, notification, agreement, media and fulfillment features provided through it.

Live experiences are run by independent operators. Where an operator collects information through Gatelyst, that operator’s own privacy practices may also apply to its handling of that information.

Depending on how you use the service, we may collect:

• Contact details: name, email address, mobile phone number, company or organization
• Transaction and order information: what was purchased or registered for, order status, amounts and references
• Event and experience participation information: the experience, session, resource or operator involved
• Queue and session information: position, status, check-in, call-up and completion
• Agreement and release records: which version you agreed to, when, and the permissions granted
• Media associations: which photographs or video relate to which participant and session
• Merchandise and fulfillment data: items, variants, stock movements, pickup codes and collection status
• Communications: messages sent to you, delivery status, and customer support correspondence
• Content and publication metadata: what was produced, its approval state and where it was published
• Device, browser and technical log information, including IP address, where actually collected
• Payment metadata and status

We do not store complete payment card numbers. Card details are collected and processed by the applicable payment provider. We receive transaction metadata such as status, amount and reference.

• Directly from you, when you register, purchase, sign an agreement or contact us
• Through a Gatelyst-powered checkout or registration flow operated by an independent business
• Through operator workflows, such as check-in, queue management and fulfillment
• Through event operations, such as media capture associated with your session
• Automatically, through cookies and technical logs where used
• From connected integrations and service providers acting on our or an operator’s behalf

• To provide the services you or an operator requested
• To process and coordinate event transactions
• To manage queues and communicate position and status
• To deliver transactional and operational notifications
• To administer agreements, releases and media permissions
• To produce and deliver media to the person it depicts
• To fulfil merchandise orders and manage inventory
• To provide customer support
• To maintain security, prevent fraud and abuse, and protect the platform
• To measure platform performance and reliability
• To provide analytics and reporting to the applicable operator
• To comply with legal, accounting and regulatory obligations

We collect a mobile number when you provide it in order to receive transactional or operational messages about an experience, purchase, registration, queue, fulfillment or support interaction. We also record the fact and time of your consent, and any subsequent opt-out, because keeping that record is how we honour it.

What we do share, and why. To actually deliver a message, the number and message content must be passed to our messaging provider. Service providers of this kind process the information solely to perform the service for us, under contractual and privacy obligations, and are not permitted to use it for their own marketing. That is a different thing from selling or sharing your information for third-party marketing, which we do not do.

You can opt out at any time by replying STOP to any program message, and you can request help by replying HELP. Full program disclosures — program name, message frequency, carrier rates, opt-out and help — are set out in the SMS / MMS program terms.

Gatelyst is a multi-tenant platform. Much of the information processed through it relates to an experience run by an independent operator.

Depending on the context, that operator may determine how customer and event information is used, with Gatelyst acting as a service provider or processor on that operator’s behalf. In other contexts — for example our own website, sales enquiries and platform administration — we determine the purposes ourselves. These roles vary by situation and by applicable law, and we do not claim a single fixed characterisation for every case.

Tenant data is separated within the platform, and one operator cannot access another operator’s customer records.

We use third-party service providers to operate the platform. By category, these include:

• SMS and messaging providers
• Email delivery providers
• Cloud hosting and object storage
• Payment processors
• Media processing and delivery
• Analytics, monitoring and security
• Publishing and content-distribution services, where an operator connects them

These providers receive only what they need to perform their function, and are bound by contractual and privacy obligations. We do not sell personal information.

We may also disclose information where required by law, to enforce our terms, or to protect the rights, safety and property of Emergent Marketing Inc., our operators or the public.

YouTube and Google. Where an operator chooses to publish content to its own YouTube channel, the connection is authorized through Google OAuth. We process the connected-account information needed to provide the publishing functionality the operator authorized. We do not receive or store your Google password.

Repurpose.io. Repurpose.io is a third-party service. Where an operator uses it, that account and any social accounts connected to it belong to the operator and are governed by those services’ own terms and privacy policies. Gatelyst does not receive or store operators’ social media passwords or two-factor codes.

We use cookies and similar technologies that are necessary for the service to function, such as maintaining a signed-in session and keeping the platform secure. We also keep server logs, which may include IP address, request details and timestamps, for security, troubleshooting and abuse prevention.

We do not use third-party advertising cookies and we do not operate an advertising network.

We retain information for as long as necessary to provide the service and for related legitimate operational purposes, including legal, accounting, tax and regulatory obligations, security and abuse prevention, contractual requirements, and the resolution of disputes.

Certain records are retained specifically because they are evidence: an executed agreement or release, and the record of an SMS consent or opt-out, are kept so that what was agreed can be demonstrated later.

We use reasonable technical and organisational safeguards appropriate to the information we handle. These include transport encryption, encryption at rest for sensitive credentials, database-level tenant isolation, access controls, and audit logging of administrative actions.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

The Gatelyst website is a general-audience business website and is not directed to children under 13, and we do not knowingly collect personal information from children under 13 through it.

Some live experiences permit minors to participate. Where they do, information about a minor participant may be processed in connection with that experience through a guardian-involved workflow, in which a parent or guardian provides the required consent and countersignature. Minors are not able to complete those consents independently where the operator’s workflow requires a guardian.

Depending on where you live, you may have rights regarding your personal information, which can include requesting access to it, requesting correction or deletion, requesting a copy in a portable form, and objecting to or restricting certain processing. The rights that actually apply to you depend on your jurisdiction and circumstances, and we do not claim that any particular statutory right applies universally.

To make a request, contact us using the details below. We may need to verify your identity before acting. Where we process information on behalf of an operator, we may direct your request to that operator, or act on their instruction.

You can opt out of SMS messages at any time by replying STOP, without making any other request.

We may update this policy. When we do, we will revise the effective date shown at the top of this page, and material changes will be indicated here. Continued use of the service after an update constitutes acceptance of the updated policy.
